Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Linkr ("the Service"), operated by Mark Rabey ("I", "me", or "my"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using it, you represent that you meet this requirement and that all information you provide is accurate and current.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify me immediately at mark@linkr.ing if you believe your account has been compromised.

4. Acceptable Use

You may not use the Service to:

• Shorten URLs that link to illegal content or activity;
• Distribute malware, phishing pages, or other malicious content;
• Send spam or unsolicited communications;
• Circumvent geographic restrictions or access controls;
• Infringe any intellectual property, privacy, or other rights of third parties;
• Interfere with or disrupt the Service or its infrastructure;
• Harvest data from the Service using automated means without my written consent.

I reserve the right to suspend or terminate any link or account that violates these rules, without prior notice.

5. Paid Plans and Billing

Certain features are available on a paid Pro subscription. Payments are processed by Stripe. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. Refunds are not provided for partial periods. Plan limits (links, clicks, analytics retention) are enforced server-side and may change with reasonable notice.

6. Service Availability

The Service is provided "as is" and "as available." I make no guarantee of uptime, and I may modify, suspend, or discontinue any part of the Service at any time. I am not liable for any losses resulting from downtime or service changes.

7. Intellectual Property

All content, design, and code comprising the Service is owned by or licensed to me. You retain ownership of the URLs and content you submit, but grant me a limited licence to process and store them solely to provide the Service.

8. Limitation of Liability

To the fullest extent permitted by applicable law, I am not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of or inability to use the Service. My total liability to you for any claim will not exceed the amount you paid me in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Mark Rabey from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of Ontario.

11. Changes to These Terms

I may update these Terms from time to time. Material changes will be communicated by updating the effective date above and, where appropriate, by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
